It's lucky for DISH that the judge is allowing them to interpret the injunction so favorably to themselves. TiVo might have thought that installed devices that infringe were to be "deactivated" and that DISH would have to prove to the satisfaction of the court that the new software did not infringe BEFORE it would be acceptable for installation or use.
