DISH Network says some models of DVR can no longer be sold

Although DISH Network was quick to assure customers that their DVRs would stay functional after losing its patent appeal against TiVo, it looks like the company was a bit quick on the draw. Although the majority of the company's DVRs have had their software updated to include non-infringing code, the VIP 721, 921, 942 and Homezone 1022 boxes haven't been updated and installers are being told that they can no longer install or activate them. You're safe if you've already got one up and running, but if you were in the market for a specific box, it's probably wise to double check those numbers.

It's lucky for DISH that the judge is allowing them to interpret the injunction so favorably to themselves. TiVo might have thought that installed devices that infringe were to be "deactivated" and that DISH would have to prove to the satisfaction of the court that the new software did not infringe BEFORE it would be acceptable for installation or use.

Oh, wait, you mean this is all DISH's idea?

I have not read one single article that explains exactly how the new software causes Dish DVRs to avoid TIVO's patents. Does it really avoid the patents or is this just Dish posturing and playing for more time? Does TIVO agree that the new software does not infringe their patents?
