This is from the product page on Lik-Sang.
It says "Official Microsoft Xbox 360 Component HDAV Cable" which would imply it is still using the Component out but with an HDMI adapter?
Similar to using a DVI->HDMI adapter.
It could be a typo and I'm hoping this is not the case.

HDMI is based on DVI so this makes sense. Compenent is not digital so unless the cable has a dongle attached to it and is digitizing analog video on the fly, the HDMI cable will be seperate from component. Is seems likely that there is digital video output in the 360 that isn't being used by the current cable. Microsoft has stated that in the future they would offer HDMI, so this cable is not a total suprise.

I'm totally guessing here, but I would guess that the HDCP portion of the puzzle is handled in the HD-DVD player add-on itself, with the licensing hardware there.
